JEWISH MARRIAGE CONTRACTS

from the Second Firkovich Collection

O.Vasilyeva

Abraham ben Samuel Firkovich
The Jewish marriage contracts form a section of the Second Firkovich Collection. This type of a legal document called a ketubah (pl. ketubot) was required at every Jewish wedding. Traditional ketubot are written in the Aramaic language, but with Hebrew characters. The Karaites use ketubot written in Hebrew. Any contract must specify such obligatory information about the wedding as the date and place, the full names of the bride and groom, the proposal formula in which the groom says to his bride that he takes her to be his wife, financial responsibilities of the groom to the bride (bride-price paid by the groom to the bride for the marriage and additional amounts,) and signatures of witnesses.

Marriage contract between Joseph ha-Levi ben Jehuda ha-Levi, son Obadiah ha-Levi, with Zubaydah bat Obadiah ben David
Marriage contracts from the Second Collection with few exceptions were purchased Firkovich in 1864 during his trip across the Middle East, particularly in the Karaite community in Cairo: the vast majority of them were signed between the Karaites in this city. In addition, there is one contract from Damascus (No. 9), one more is from Qirq Yer (Chufut-Kale, a medieval city-fortress in the Crimea) (No. 27) and one document is from Calcutta (No. 76). The contracts covers the period from the 13th to the 19th centuries. Dates are based on the calendar "from the creation of the world" or the years were counted using a system of numbering years according to the Seleucid Era.

A marriage contract is not only the most important and, sometimes, the only document in the family, it is also a valuable historical source of information on genealogy and ethnography etc. For example, the list of a bride's dowry provides information about garments and everyday household items used in a particular time in a particular place (No. 76).

"Epithets of praise" are often attached to a man's name: for instance, the word Kohen (from a family of priests descended from the biblical Aaron) are found in 16 contracts, Levi (a descendant of the tribe of Levi) are used in 26 documents and one bridegroom held the honorary title of Nasi (meaning Prince). Simetimes, epithets for a groom and fathers of a couple getting married indicated their professions: Hazzan — a cantor, Rofeh — the hebrew word for a medical doctor.

Yet, it is not always possible to say with certainty whether the word Rofeh means the profession, or it has already become an integral part of the name, the conclusion about the importance of practicing medicine inevitably comes to mind (it is worth mentioning that the Judaist doctors treated not only their coreligionists, but also Muslims and Christians).

Not many, but some ketubot contain names of scribes. For instance, it is known that Aharon Mimar transcribed the ketubah dated to 1656 (No. 14). Baruch Rofeh left his name on the three contracts: dated to 1675 (No. 18), to 1686 (No. 19), to 1698 (No. 21). Shlomo Kohen Dimashqi wrote the ketubah in 1777 (No. 43), Hazzan <…> Rofeh recorded one contract (No. 53). Four documents were written by hand of Joseph Kohen, a son of Nesim Kohen Dimashqi: two in 1816 (No. 60, 61), one - in 1817 (No. 63) and one with the missing date (No. 73).

Records of witnesses are sometimes made in Arabic but wit Hebrew characters, that is not surprising, since Arabic was the spoken language of the Jews in Egypt. The reverse side of the contract dated to 1645 carries an unusual note - a confirmation of the groom that his bride was a virgin (No. 13).

Marriage contract between the Rabbanite Avraham Ashkenazi ben Joseph and Esther bat Shemuel
The contracts are written either on paper, or on parchment of a large size up to: 95 cm high and 71 cm wide. The smallest document is a contract signed in 1815 in Cairo, measuring 27.5 x 21.5 cm. It is not always easy to determine the original form of documents because of the considerable damage of the parchment.

The contracts have been created in a wide range of designs. These documents have different forms. Among them, you can see a rectangle, a trapezoid, but more often – a pentagon with an acute bottom coner. In two cases, the fifth corner is located at the top of the document (No. 27, 59). Ink is black or brown, red ink is often used in decorating and ruling. It is worth noting that a ruling line is placed above a line of text, not underneath it.

Marriage contract between Ezekiel ben Ezra and Maryam bat Moshe
18 marrage contracts from Cairo, dated from 1740s to 1830s, feature ornamental frames along their edges, executed with red, green, and yellow paints in their margins. But the most luxuriously embellished documents are the Karaite ketubah of 1719 from the Crimea and the Indian contract of 1851. The latter includes images of living beings: two lions and two fish. It belonged to the Baghdad Jewish community, several members of which lived in Calcutta.

Many leaves have been significantly damaged from damp, many got torn off, creased, stained, so some pieces of text have been lost. This can testify in favor of the assumption that they were found in the Cairo Geniza, like the vast majority of manuscripts from the Second Firkovich Collection.

Marriage contract between the Karaite Joshua ben Mordechai ben Pinchas ha-Rofeh and Sathit bat Shemuel ha-Rofeh ben Avraham ha-Rofeh
The marriage contracts came to the Library as part of the Second Firkovich Collection purchased in 1876. The printed "Report of the Imperial Public Library" for this year only briefly mentioned 'a collection of about 500 ancient documents on parchment and paper, consisting of deeds and marriage contracts…, correspondence between Karaite communities… and so on'. Apparently, the documents had not been described for a long time, although they were preserved as a single collection: they do not have any notations, but the backs of the majority of sheets, like a draft copy of the contract of 1639, contain a date of a document written in blue pencil. Obviously, these inscriptions are made by Firkovich himself, because the manuscripts from other sections of his Second Collection are date-marked in the same way. In 1969, V. Lebedev arranged the section in chronological order, compiled its catalogue and inventory in which 76 contracts were listed. At the same time, the most damaged documents have been restored.

At the beginning of the 1990s, some Hebrew manuscripts were stolen from the Library, among them were 9 marriage contracts, including the oldest document signed in Cairo in 1367, - the ketubah of the head of the Egyptian Karaites Solomon ben David ben Ele‘azar, son of Uzziiah, and Sathit bat … ben Avraham.

In 1995, the Israel Museum returned to our Library the contract of 1719, which was acquired by them from an antique dealer. In 1997, the law enforcement agency provided for the examination a colour copy (produced by a printer) of the contract of 1757. The original of this document had been previously stored in the Library. Unfortunately, it was unable to return this ketubah, and the location of this contract, as well as of the other seven missing ketubot, remains unknown. Thus, the holdings currently have 68 items covering the period from 1499 to 1851.

Data about the missing contracts are also included in the catalogue which is compiled on the basis of the card catalogue and inventory made in 1969, maintaining the principle of transliteration of proper names, but in a simplified form. Information about the size of documents, their shape, decoration, physical condition, restoration and publications in albums has been added or accurated, while completing the inventory. Digital copies are made in the Department of External Services.
